Breach of Land Sale Contract

In a case involving a multimillion dollar sale of a shopping center, our client brought an arbitration claim against the developer who sold the shopping center. The claim was for damages in the form of lost business and tenants resulting from the developer’s failure to meet its contractual obligation to construct a second access point for the center. We obtained an award in favor of our client at the conclusion of the arbitration.


Fraud

We represented the purchaser of commercial real estate in a claim for fraud because of material misrepresentations related to the condition of the property at the time of purchase. We obtained an award in favor of our client at the conclusion of arbitration.

We represent the Federal Deposit Insurance Corporation in its capacity as conservator for a federal savings bank in an action involving a broad conspiracy to commit mortgage fraud.

 

Negligent Misrepresentation

We represented a couple who had purchased property for the construction of their home. Shortly after construction was complete, their home was destroyed in a landslide. They brought claims of negligent misrepresentation and fraud against the developer and others for failure to disclose the condition of the property at the time of sale.

 

Breach of Commercial Lease

The firm represented a commercial property owner who brought claims against a tenant for negligence and breach of contract due to the tenant’s failure to properly maintain the property. The case was settled just before arbitration on terms very favorable to our client.
